US Court Orders Freedom of Kilmar Abrego Garcia from Immigration Custody
A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his continued detainment lacks lawful basis.
"Since his return from wrongful detention in El Salvador, he has been re-detained, again without legal justification," the judge stated in her ruling.
The situation originates in a mistaken removal to El Salvador in March, which US authorities later acknowledged was an error. Following his repatriation to the United States to answer alien smuggling allegations, he was detained in federal detention.
In her decision, the court noted that the government does not have a current removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."
Context of the Legal Challenge
The court challenge center on conflicting assertions. While the former administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he categorically denies this claim.
He has also pleaded not guilty to the smuggling charges, which are part of a separate criminal case in Tennessee.
Conditions of Release
The judge, who was overseeing his challenge to deportation in a Maryland district court, determined that he must now comply with the conditions of his bond from custody in Tennessee. This order effectively transfers his monitoring to the Tennessee court.
